Tomato Boy (Eli Rubashkyn) is applying to have his charges dropped

As reported by Simon Anderson tonight, Tomato Boy is applying for a dismissal of all charges against him under Section 147 of the Criminal Procedures Act 2011.

Essentially, he would be arguing that there is either a lack of evidence of the assault (there is video evidence), or that there was no case to answer (there’s the Common Assault case to answer, no?).

Police have advised one of the victims that they intend to oppose this application.

Accused of assaulting @ThePosieParker and @l_o_u_t, Green party activist Eliana Rubashkin was due to appear in Auckland District Court tomorrow.
